Prior Arkansas law was codified in superseded Ark. The substantial increase in the number of such proceedings in recent years has placed a considerable burden on state authorities. The Chief Justice shall appoint a presiding judge of each three-judge panel. Under the present text of the second sentence of this subdivision, the motion for dismissal at the close of the plaintiff's evidence may be made in a case tried to a jury as well as in a case tried without a jury.

The party desiring a default judgment shall file a motion for an entry of default showing that the opposing party is in default and attaching proof of service of the claim for relief. To avoid the injustice that may result if the substitute judge proceeds despite unfamiliarity with the action, the new Rule provides, in language similar to Federal Rule of Criminal Procedure 25(a), that the successor judge must certify familiarity with the record and determine that the case may be completed before that judge without prejudice to the parties.

This subdivision was added in 1980 to provide a party threatened with abusive discovery with a special means for obtaining judicial intervention other than through discrete motions under Rules 26(c) and 37(a). The hospital may produce exact copies of the records designated unless the subpoena specifies that the original records be produced. Rule 41(a)(1) was not then amended to reflect the Rule 23 changes. Wherever documents may be sent directly by the postal service based on such agreements in international instruments, they shall be served by registered mail, return receipt requested; in all other cases, service shall be made, at the request of the presiding judge of the court hearing the case, directly by the public authorities of the other state. (2) Should it not be possible to serve the documents in accordance with subsection�(1), the responsible diplomatic or consular mission of the Federal Republic or any other public authority responsible shall serve the documents.

Construction of certain references 49.8.
